PCA Case No. 2022-13 - KN Holding LLC & Severgroup LLC v. the French Republic - Affaire CPA N° 2022-13 - KN Holding LLC & Severgroup LLC c. la République française

On 8 June 2021, the Claimants commenced arbitral proceedings against the French Republic under the Agreement between the Government of the French Republic and the Government of the Union of Soviet Socialist Republics on the Reciprocal Promotion and Protection of Investments dated 4 July 1989. The Claimants allege that the Respondent breached its obligations under that Agreement with regard to their rights to exploit gold and other resources in the Montagne d’Or area in French Guiana.

 

Le 8 juin 2021, les Demanderesses ont initié une procédure arbitrale contre la République française sur le fondement de l’Accord entre le Gouvernement de la République française et le Gouvernement de l’Union des Républiques socialistes soviétiques sur l’encouragement et la protection réciproques des investissements signé le 4 juillet 1989. Les Demanderesses allèguent que la Défenderesse a manqué à ses obligations au titre de cet Accord s’agissant des droits des Demanderesses d’exploiter de l’or et d’autres ressources dans la zone de la Montagne d’Or, en Guyane française.
