Bilcon of Delaware et al. v. Canada

Beginning on October 22, 2013, the hearing on jurisdiction and liability in an arbitration between Bilcon of Delaware et al. and the Government of Canada will be streamed live on the website of the Permanent Court of Arbitration (PCA). Click here to open the live feed in a new browser window.

The hearing will be held in Toronto, Canada, and will begin on Tuesday, October 22, 2013 at 9:30am EDT (Eastern Daylight Time). The hearing is scheduled to conclude on Thursday, October 31, 2013. The tribunal will not sit on Saturday, October 26, 2013 or Sunday, October 27, 2013.

The arbitration was commenced in 2009 by Bilcon of Delaware, a United States corporation, and its shareholders pursuant to Chapter Eleven of the North American Free Trade Agreement (NAFTA). The tribunal is chaired by Judge Bruno Simma, Judge at the Iran-U.S. Claims Tribunal. The other members of the tribunal are Professor Donald McRae, Hyman Soloway Chair and Professor of Law at the University of Ottawa, and Professor Bryan Schwartz, Professor of Law at the University of Manitoba. The PCA acts as registry in the arbitration.
